Currently in our society showing existing violence in the world, among others. One sees and reads on corruption, terrorist attacks, the drugs and the domination of women by some groups. It is because human rights are being violated. But what is here is so different?
Canada, among other countries, reported rates of assaults and sexual harassment on the highest workplace, according to the international labour office in its report on the global study of violence at work (ILO, 1998) (1).
Would have the situation changed? Not really. "Violence in the workplace is a harsh reality in health care organizations. Although most often associated violence in the workplace physical violence on the part of users, it is not limited to assault, but includes also, by the share of users and leaders "rudeness, verbal intimidation, the dissemination of rumors, the lyrics and threatening gestures and harassment" and "most of the incidents of violence in the workplace. As the verbal or psychological abuse are never reported» (Accreditation Canada, 2015) (2).
Violence in the workplace covers a broad spectrum of unacceptable behaviour. It includes incidents where workers are abused, threatened, pushed to make out his physical limitations; they are the subject of discrimination or are assaulted in circumstances related to their work, including during their journey to and from the place of work and a threat to their safety, their health and their well-being:
-a concentration disproportionately of women at lower levels and of jobs and less pay, making them more vulnerable than those occupying the functions of power;
-an absence of measures to protect women from legislation to policy on the workplace, social and cultural pressures discouraging women to defend their own droits.
Women are frequently victims of discrimination and bullying in the workplace, including sexual harassment. Course, discrimination on the basis of sexual orientation may affect men as much as women. It is noted that gay, lesbian, bisexual, transgender groups do not have a Union list of representation that will help them to enforce their rights, especially equal opportunities to get a job or be advanced health care.
Forms of violence against women:
-mockery (your accent, your clothing or personal look, your questionable health status, what you do in your free time as sick in the inattention around of your complaints; the overestimation of your condition);
-stigma (describes reactions or feelings against a group or an individual on the basis of certain characteristics such as sex, colour, religion, State of health, the sexual orientation or any other quality.) It is very often caused by a lack of understanding - as erroneous information and ideas, fear of the unknown or simply due to intolerance);
-harassment (to be called in sick condition several times by colleagues that you insist go you to work, take news on your State, i.e. the advancement of the folder, etc.; calls with insistence by human resources that seem to be deaf ear around your unavailability for work to be sick; pass whenever your employer decides as if you were - a clown, a supposed expertise (that are only opinions) paid by him (conflict of interest);
-intromission in civilian life, in other words the arbitrary interference in the private life of others is illegal both by the Civil law as para human rights (UN, 1948, Article 12) (4):
"No one shall be subjected to arbitrary interference with his privacy, family, home or correspondence, nor to attacks upon his honour and reputation. Any person has the right to the protection of the law against such interference or such abuses ".
Physical abuse is the use of physical force against another person causing physical and/or psychological harm. Examples include the fact of push, pinch, beating, slapping, give kicked, stabbed, shots or even rape. The lack of diagnostic and treatment appropriate to his condition of health by the accidentes occupational diseases with negative impact on health and well-being, will not be a not - t - they a form of violence against women in employment? Deny a sufficient number of breaks - pee, coffee - breaks, overload the employees tasks outside of its physical and mental forces, knowing which affect health and the safe continuation of tasks, not will be not-does a form of violence? Yes, it is.
«Any injustice against a single person, represents a threat to all». Montesquieu
Psychological violence is an abuse of power, including the threat of resorting to physical force or to do something that you will hurt, against another person or another group that may cause injury to their physical, mental, spiritual, moral or social welfare.
Can be one of stigma and discrimination and this can take several forms: verbal abuse, bullying/intimidation and threats. Abuse of power is exacerbated by gender inequality and find expression in sexual harassment and discrimination.
Similarly, racist attitudes lead to racial harassment and discrimination. Long underrated psychological violence seems now more common than physical violence (who-ILO-CIE, 2002) (op.cit.3).
Vocabulary to hold dear:
assault/attack - behavior intended to hurt or physically harming another person, including sexual assault.
Abuse - behaviour that humiliates, degrades or otherwise indicates a lack of respect for the dignity and worth of a person.
Intimidation/bullying - attempts vindictive, cruel or malicious repeated to humiliate or decrease an individual or groups of employees.
Harassment - similar to abuse but can also include the retention of information or resources to complicate the work of an agent. The behavior can target particular characteristics of the victim, for example, in terms of age, gender, race, religion, language, handicap, sexual orientation, or a reason for her HIV status. Stalking, is a line dedicated to establish fear in others. Three dimensions need to be explored in link: temporal aspect of the reprobate Act, the emotional aspect of the person harassed and the intentional aspect of the conduct of the harasser.
Threat - promise of physical force or power use (i.e. psychological force) resulting in fear of injury physical, sexual, psychological or other negative consequences for individuals or target groups.
The United Nations defines violence against women as follows:
"All acts of violence directed against women and causing sex or cause harm to women or suffering physical, sexual or psychological, including threats of such acts, coercion or arbitrary deprivation of liberty, whether in public or in private life". 19
This violence includes the following: 20 physical: hitting, choking, beating. Assault with the hands or an object. Threatening with a knife or a gun. Commit murder.
Sexual violence: impose an unwanted activity of a sexual nature by threats, intimidation or physical force. Emotional or verbal abuse: humiliating and degrading comment about the body or the behaviour of a woman. The force to lend itself to degrading acts. The confined at home. Destroy or damage his belongings. Threaten to kill her or kill her children. Threaten to commit suicide.
Emotional or verbal abuse: humiliating and degrading comment about the body or the behaviour of a woman. The force to lend itself to degrading acts. The confined at home. Destroy or damage his belongings. Threaten to kill her or kill her children. Threaten to commit suicide.
The economic or financial abuse: stealing money or objects of value owned by a woman or her deny access (particularly worrying situation for women). The force to work or deny him the right to work. Spiritual abuse: use the religion of a woman or her spiritual beliefs to manipulate, dominate or control it.
Stalking: monitor a woman's persistent, malicious and unwanted way. Porter reached her privacy in a manner that poses a threat to his personal safety"(FONDATION CANADIENNE DES FEMMES, s/f) (5).
«264. (1) No person shall, except lawful authority, to act with respect to a person knowing that she feels harassed or without worrying what she feels harassed if the Act in question to reasonably fear - given the context - for her safety or that of one of his acquaintances. ''
((2) constitutes an act prohibited under subsection (1), the fact, as the case may be, of: has) follow this person or any of his knowledge of repeatedly; b) communicate repeated, even indirectly, with the person or one of his acquaintances; (c) identify or monitor his dwelling house or the place where this person or his knowledge resides, works, carries out its professional activity or lies; (d) behave in a threatening manner in respect of that person or of a member of his family". Criminal Code (R.S.C. 1985, c. C-46)
A chaotic example of this abuse we have it in the acceptance of spinning surprise justified by the superior court. The example publicized it was spinning a beneficiaries clerk who worked at the Centre de santé et services sociaux Vallée-de-la-Gatineau (CSSSVG) which had been followed and filmed to check the presence of pain that she said felt shoulder (Le droit, 2016) (6).
Arbitration had concluded that the reasons given by the doctor of the employer to justify spinning were not reasonable (ethically, not by law) and that the admission of the video evidence "would bring the administration of justice into disrepute. Despite this, the Superior Court has invoked "reasonable grounds". "The employer did not act arbitrarily or randomly", and that he "had reasonable grounds to submit the employee monitoring. "Accordingly, the video of this monitoring is not a violation of his right to private life", reads the decision of judge Therrien.
What is at the heart of the dispute is the money not justice. The only person that may know as she feels it is itself. Worse, there are diagnostic means to establish the course of a wrong physics and a ton of references to scientific literature to corroborate what happens during an injury professional or not, with its signs and the most frequent symptoms.
We must also bear in mind that 2 x 2 is 4 does not apply to the peerless human condition because every being has a singular identity condition which is given by its genetic heritage and its psychology, therefore, very personal.
Needed by the employer and by the doctor (paid by the first) to violate a fundamental right, a civil law, sentenced in criminal law? Remember - us medical duty is good and nice to hear the complaint of his client to avoid major complications, not to indicate forward them to someone.
Think that the doctor is not in solo, there of reports and assessments made by other interveners, including chiropractors, physiotherapists, kinesiologists, nurses in rotation but that more or less follow close to the person *. What does all this documentation is held into account in litigation? Or only the voice of a doctor paid by the same employer by the person who is under the NCSST because in both cases the money comes from the employer - is held as a revealed truth?
Let us remember that an employer, especially on behalf of the Government of Québec, is subject to the laws and recommendations emanated internationally by the international organization of labour (ILO) (8) (9) which since adapt to national, provincial and local context.
Similarly, it has to respect human rights. It can do more than these recommendations in respect of improvement but not less. Note, therefore, that the State is mixed at the provincial level and the legal administrative level. Is what does the filming was able to actually show the presence of pain? The filming can demonstrate nothing more than a rays x, a myography, MRI, etc.
The dismal corollary of all this history it has given more power to those that already have many, opening the doors to require still more, without limits and oppress in legality.
The basic problem is the misogynist: is the woman - used in this case - suspected of immoral (legacy of the paradigm) patriarchal and the myth of the poor boss (male / State) poorly remunerated for giving a job where an employee who ingratement (in connection) had been injured.
The authorities demonstrate exactly the contrary, more honesty among employees than employers. In the foreign jurisprudence because our need to consider more porch. Perhaps put it under spinning?
"-Convention on the elimination of all forms of discrimination against women, States parties shall... ensure that [women]... access to... specific lessons of educational agenda aimed at ensuring the health and well-being of families, including information and advice on family planning...". States parties shall take all appropriate measures to eliminate discrimination against women in the field of care of family... States parties shall take all appropriate measures to eliminate discrimination against women in the field of health care to provide, on the basis of the equality of man and woman, means to access medical services, including those relating to the planning of the family... provide to women during pregnancy, during childbirth and after childbirth,... appropriate services; . States parties... [must].. .ensuring... that women in rural areas... [have] access to adequate services in the field of health, including information, advice and services in family planning... »articles 10, 12 and 14.
The causes of this violence lie in the existence, in society, a belief that the needs, feelings, and beliefs of a person or a group of people are more valuable or more important than another person or another group. This fundamental inequality creates a justification psychological but not rational for acts such as humiliation, intimidation, control, violence and even murder.
This same argument was held by the Nazis to justify these aberrations. Let us not forget the five nurses who committed suicide in the year 2010 following injuries forgotten to return to work. And what ago around the employées et employés left disabled by life? Silence and blind sight to the reported of suffering, distress, anxiety, chronic fatigue, harassment in the hands of physicians with the complicity of the unions syndicalist.
In time to play the villains with the vulnerable and empower victims of accidents at work, the right should be fine and beautiful ensure that preventive measures be fulfilled 100% with a "patronage 0" and impose large fines for each condition more workable protective of health and safety in the workplace not misse in place nor respected , as well as any basic dignity and integrity law.
What to say of the lapsing of the list of diseases which are presumed to be professional which is not renewed since the year 1985? Incredibly, the development of scientific knowledge have not arrived in Quebec or the Commission's standards, equity, health and safety of labour (CNESST) (Uttam, s/f).
My (in) human experience in Quebec, Canada
For three years and six months of an accident to work as Clinical nurse where I stay with a spondylolisthesis, two Herniated discs, more tear at the root of the sciatic nerve on the side of right, tremor** (effort-position,higth pain), instability articular sacro - iliac, accompanied by throbbing pain, sensation of intense electrical wires radiating out from the bottom of the back towards the buttocks or thigh, more on the right than on the left.
This pain down the thigh and leg and ending in the foot tends to increase when I move, I cough, I sneeze or I make efforts to go to the saddle. I have tingling, numbness and cramps in the two lower limbs. Found by physiotherapists, on l left side, I have a part of the journey of the nerves sciatic pain and right on the whole. I can not move my own way, less at long distances. I has a shortcut step and an approach of duck with all my organs moved forward which gives the idea of a belly that overflows and does not have a trunk.
Unsteady gait, I rely on a cane walking visa and my right leg rotates inward and backward, phenomenon which begins to the left. I have constant headaches, with all my back misalign. I have pain at the bottom of the back to reflex and deep breathing to the bottom of the belly, hip to hip. Push my hand against the right buttock raises electrical wires on the thigh and near the thigh.
In the end, my two members are in constant pain. I ban to walk long distances, to remain long time sitting, standing, to put me in position of genuflecting, of roter trunk, look forward and backward, to climb from markets, ultimately, I can do anything.
I can't lift more than 4 Kilos and I do, I see las immediate consequences, but all this is irrelevant by doctors that deepening my disability and my suffering without operated on me and allow me to lead a fulfilling life. Note that if there is disc herniation causing a sciatic neuralgia, surgery is recommended in severe cases (10). If my case is not severe c ' is what then?
I gained weight, I have intolerance to drugs per sos, my liver and my stomach can no longer, my aesthetic is terribly affected. By orthopedic shoes indicated by reaches neurological there is not money but to pay doctors 100% more expensive there. Everything besides that I was dismissed and of course, filmed without using it can demonstrate nothing. This is negligence and the wickedness of a system that violates the citizen empowerment.
Education and change
It must:
1.Be aware of the fragile human condition and the value of human life.
2. Raising awareness on the presence of the patriarchal paradigm that impregnated to society as a whole resulting from gender inequality.
3. Awareness about the limits of Cartesian paradigm strain, which excluded incompleteness, mistake, the unique possible. Ultimately, change the educational curriculum to the Paradigm Complex Thinking of Edgar Morin, adding pedagogical posture of Paulo Freire.
4.Work, since all domains, with the perspective of respect for basic human rights and principles that ensures good judgement:
4.Work, since all domains, with the perspective of respect for basic human rights and principles that ensures good judgement:
I Principles of reason

Principle 2: The principle of non-contradiction (Plato and Aristotle) of opinions or valid theories must not contain internal contradictions.
Classic formulation: a real being cannot both be and not be the same thing, in the same respect, the same place and at the same time.
Principle 3: The principle of objective evidence (Plato and Aristotle) the non-arbitrary opinions or theories should be based on publicly verifiable evidence.
II. Ethical principles
Principle 4: the principle of non-maleficence (Jesus, Moses and the religious traditions in the world) avoid unnecessary harm; If a damage is unavoidable, minimize it.
Gold rule: Do not to others what you would not have them do unto you.
Principle 5: The principle of the coherent end with the means (Augustin) the end does not justify the means. Principle 6: The principle of human potential (Las Casas).
Avoid unnecessary harm; if damage is unavoidable, minimize it.
Gold rule : Do not to others what you would not have them do unto you.
Principle 5: The principle of the coherent end with the means (St-(Augustin)
Principle 6: The principle of human potential (Las Casas)
Every human being (or a group of beings humans) deserves to be evaluated according to the level of full human development and not currently stands at development level.
III. The principles of justice and natural law
Principle 7: The principle of natural rights (Suarez, Locke, Jefferson and Paine)
All human beings humans have in themselves (by virtue of their very existence) the inalienable rights to life, liberty and property; No Government can give these rights and no Government can remove them.
Principle 8: The principle of the fundamental nature of the rights of man (Suarez, Locke and Jefferson) law the most fundamental is that which is necessary for the possibility of others, when there is a conflict, we must resolve it in favour of the most fundamental right.
Principle 9: The principle of the limits of freedom (Locke and Montesquieu) a person (or a group) cannot impose unnecessary burdens to other people (or groups).
IV. The fundamental principle of personal identity and culture
Principle 10: The principle of beneficence When our grass is not greener than elsewhere.
5. It is necessary support its action following the recommendations of the ILO and work to improve them.
6. Recognize the human potential more than the physical envelope.
7. Developing citizen participatory skills
Conclusion
Awareness of women employed in environments of health or any other area in face of desired and unacceptable behaviour is an important element in the prevention of serious violence, stigma and discrimination in the workplace that begins with the home.
Often the victims and witnesses are afraid to speak out and suffer in silence. Encouragement, stakeholders appropriate to break the silence are therefore of crucial importance.
Develop an alert and beneficent attitude to identify these situations is a critical educational task. Report incidents are a right and a human ethical duty to keep the rights of all.
